OBJECTIVES

 

  • To establish awareness in the public of the diseases that may emerge from environmental pollution and its ways of prevention.

 

  • To identify and evaluate environmental health risks that may affect the public health and environment.

 

  • To ensure every building activities are safe and healthy to the environment and the public.

 

  • To ensure every environmental development and its activities fulfil the health and safety guidelines to avoid disruption and pollution to the environmenT

FUNCTIONS

 ​​


1.     Prepares planning and conducts monitoring activities, assessment, management and control of environmental pollution in areas such as:

 

    • Waste disposal, including solid waste, industrial waste, food waste, chemical waste, clinical waste and other wastes that could cause environmental pollution and problem to environment and public health and safety.

       
    • Water quality including raw water source and treated water supply so as to prevent microbiological, chemical and other contamination for safe and healthy use by the public.

 

    • Development activities including private housing construction, industrial, commercial, recreational and others related to the safety and health of the public and environment.

 

2.   To ensure all monitoring programs, assessment and management of health risk and environment are carried out as planned.

 

3.     To carry out investigative activities, inspections and monitoring on cases such as:

 

    • Complaint

 

    • Infectious diseases caused by environmental health and safety matters addressed by Disease Control Division.

 

4.     To prepare and carry out awareness programs regarding the importance of environmental health and safety for the public via education, information and distribution on environmental health knowledge.

 

5.     To carry out inspections, assessment and submit a report, based on health requirement, for applications that require further approval/authorization from the relevant Government agencies to carry out commercial activities, development and other related activities.

 

6.     To collaborate with other relevant Government agencies to handle and assist in natural disaster cases that is reported to the Department of Health Services.

 

7.     To give advice to consumers regarding anything that is related to environmental health.

GUIDELINES AND INFORMATION ON THE APPLICATION FOR A TOBACCO IMPORT AND WHOLESALE LICENCE

 

A person who intends to import and sell by wholesale tobacco products must apply for an Import and Wholesale Tobacco Licence from the Environmental Health Development Unit (Licensing Section), Environmental Health Division, Department of Health Services, Ministry of Health, and Brunei Darussalam.

 

HOW TO APPLY?

 

  1.  The application form is for an import and wholesale tobacco licence.
  2. All entries shall be made in Malay or English.
  3. Particulars entered must be in block letters.  All the information required in the form should be supplied as far as they are applicable.  Incomplete form or forms filled illegibly shall be returned and this will cause unnecessary delay in the processing of the application.

     
  4. The firm / company shall authorize a person in the position of either a chairman/managing director / proprietor / partner to apply for the licence on its behalf.  This person must be residing in Brunei Darussalam and responsible for the management of the business for which the licence is issued.

     
  5. The licence shall be issued in the name of the applicant and the local firm / company registered with the Registry of Companies and Business & obtain Certificate of Business Registration Section 16 & 17 / Form-X.

     
  6. All supporting documents, not in Malay or English, must be translated into Malay or English.  Both the supporting documents and the translated version must be submitted.  Any additional details regarding the application must be submitted upon request by the Environmental Health Development Unit (Licensing Section), Environmental Health Division, Department of Health Services.

     
  7. When filling in the particulars required in the form, if then space provided is insufficient, a separate sheet of A4 sixe paper should be used.

     
  8. Licence fee for an import and wholesale tobacco licence is B$2,500 per year.  Cheque payment shall be crossed and made payable to "Department of Health Services".  Applicant must indicate his / her registry number on the overleaf of their cheque.  The cheque also needs prior endorsement from the concerned bank.

     
  9. Completed application form, together with the payment of licence fee and supporting documents are to be submitted to:

    Applicant must also be citizens or permanent residences of Brunei Darussalam, residing in Brunei Darussalam and responsible for the management of the business for which the licence is issued.

     

    All applicants are required to submit the documents listed below in Malay / English language for our processing:

     
    1. Photocopy of identity Card of applicant

       
    2. Two recent passport size photographs of applicant

       
    3. Photocopy of Business Registration Certificate Section 16 & 17 / Form-X

       
    4. Copy of tenancy agreement for warehouse.

       
    5. Specimen of tobacco product packaging

       
    6. Enquiry on health warning and labelling of tobacco products

       
    7. Rotation Schedule of Health Warning Labelling

       
    8. Letter of authorization from manufacturer on the tobacco products to be imported (or Letter of authorization from importer for wholesalers)

       
    9. Tar and nicotine testing results from an accredited Cigarette Testing Laboratory

       
    10. Copy of manufacturing / premise licence from the country of origin

FURNISHING OF INFORMATION

 

1.  The holder of an import and wholesale tobacco licence shall maintain information on the import,    

Sale and supply of tobacco products imported into Brunei Darussalam for a period of at least 2 years from the last date of entry with the following details (Regulation 14, Licensing Regulation 2007):

 

    1. Brand & Type of Tobacco Products
    2. Lot & Batch Number
    3. Delivery Date
    4. Date of Receipt or Sale
    5. Invoice / Delivery Number
    6. Name of Supplier / Retailer
    7. Address of Supplier / Retailer
    8. Expiry Date
    9. Quantity Received
    10. Quantity Sold
    11. Stock Balance

       

      2.  Such information shall be made readily available upon request by the Tobacco Control Unit, Department of Health Services.

       

      LEGISLATION

       

      The applicant should familiarize with the following legislations:

       
  1. Tobacco Order 2005

     
  2. Tobacco (Licensing of Importers, wholesalers and Retailers) Regulations 2007

     
  3. Tobacco (Labelling) Regulations 2007

GUIDELINES AND INFORMATION ON THE APPLICATION FOR A TOBACCO RETAIL LICENCE

 

A person who intends to sell tobacco products by retail must apply for a Tobacco Retail Licence from the Environmental Health Development Unit (Licensing Section), Environmental Health Division, Department of Health Services, Ministry of Health, Brunei Darussalam. Tobacco retail licence issued is specific to ONLY ONE OUTLET. Separate applications need to be submitted if an applicant is operating more than one outlet.

 

HOW TO APPLY

 

  1. The application form is for retail tobacco licence.
  2. All entries shall be made in Malay or English.
  3. Particulars entered must be in block letters, all the information required in the form should be supplied as far as they are applicable. Incomplete forms of forms filled illegibly shall be returned and this will cause unnecessary delay in the processing of the application.

     
  4. All supporting documents and any additional details regarding the application must be submitted. Incomplete supporting documents will also cause unnecessary delay in the processing of the application.

     
  5. When filling in the particulars required in the form, if the space provided is insufficient, a separate sheet of A4 size paper should be used.

     
  6. Licence for tobacco retail licence is B$300 per year. Cheque payment shall be crossed and made payable to "Department of Health Services". Applicant must indicate his / her registry number on the overleaf of their cheque. The cheque also needs prior endorsement from the concerned bank.

     
  7. Completed application form, together with the payment of licence fee and supporting documents, to be submitted to:

SUPPORTING DOCUMENTS

 

Applicants must hold valid Business Registration Certificate Section 16 & 17 / Form-X.

Applicants must also hold valid Miscellaneous Licence.

Retail outlets eligible to apply are provision shops and supermarkets only.

Documents required during the submissions of licence application are:

  1. Photocopy of Identity Card of applicant (only for yellow/red identity card holder).
  2. Two recent passport size photographs of applicant.
  3. Photocopy of Registry of Companies & Businesses Certificate Section 16 & 17/ Form-X.
  4. Photocopy of a Valid Miscellaneous Licence.
  5. Tenancy Agreement / Letter of Offer.
  6. Authorization letter (applicant applying on behalf of company).
